Former guidance counselor sued over ‘sexting’ incident

A teenager and her family are suing the Clark County School District and a former middle school guidance counselor over a “sexting” incident in 2009.

The lawsuit, filed Friday in Las Vegas federal court by “Jane Doe” and her father, is asking for an unspecified amount of money from the district and Franz Fajardo, the ex-guidance counselor.

Fajardo was arrested in April 2009 for using his cellphone to send lewd text messages to the then 13-year-old student.

Fajardo was an employee at Saville Middle School at Torrey Pines and Grand Teton drives. He was fired a month after his arrest. In September he pleaded guilty to attempted lewdness with a child under the age of 14. As part of a deal, prosecutors agreed to drop 16 other felony counts against him.

Fajardo, 42, was sentenced in November to three to 10 years in prison and is being held at High Desert State Prison.
