Doctor agrees to settlement in health care fraud case

A Las Vegas pain management doctor has agreed to pay a little more than $1 million to settle a health care fraud case with the U.S. Department of Justice.

According to a statement from U.S. Attorney Daniel Bogden, Dr. Steven Kozmary agreed to the settlement for “improperly” billing federal health insurers.

Kozmary targeted Medicare, Tricare and the Federal Employee Health Benefits Program from July 2007 through December 2010, according to Bogden.

The agreement, which became effective Dec. 13, allows Kozmary to avoid admitting liability while acknowledging the government’s case is “well founded.”

The federal agencies involved, however, could seek to exclude Kozmary from participating in federal health care programs, according to the agreement.
