Lawsuit over Henderson casino delayed

Henderson’s efforts to have a lawsuit brought by a Station Casinos Inc. property against the city in November dismissed will have to wait for at least a month, a city spokesman said.

Bud Cranor, the city’s public information manager, said District Court Judge Joanna Kishner on Monday recused herself from the trial after disclosing she had done some legal work for Station Casinos.

Cranor expects another judge to be appointed within 30 to 45 days. A Station Casinos property had sued the city of Henderson over the city’s approval of Roadhouse Casino’s, a potential competitor, operating permit.

The gaming company also sued Robert McMackin, owner of the Roadhouse, and Marengo Inc. In its lawsuit, the casino did not challenge the state gaming license held by Roadhouse, but challenged the city license.

Sunset Station and two nearby sister properties, Fiesta Henderson and Boulder Station, all have hotels, and Station Casinos opposes plans by McMackin to operate the casino without having to build a hotel.
