Ex-49er Ray McDonald charged with rape

Former San Francisco 49ers player Ray McDonald was indicted this week by a grand jury on one count of rape of an intoxicated person, the Santa Clara County prosecutor’s office said on Wednesday.

The indictment stems from a December 2014 incident at the home of McDonald, 30, an eight-year veteran of the National Football League, the district attorney’s office said.

The former defensive end faces up to eight years in prison if convicted of the rape charge.

He also was indicted on a charge of violating a domestic-violence restraining order in May, which carries a maximum penalty of one year in jail, the prosecutor’s office said.

McDonald was released by the team in December after he was named as a possible suspect in the case.

The prosecutor’s office said current 49ers linebacker Ahmad Brooks, 31, was charged separately with misdemeanor sexual battery stemming from an alleged assault that occurred the same evening against the same woman McDonald is accused of raping.

Brooks faces a maximum sentence of six months in jail if convicted.

Neither the NFL nor the 49ers had an immediate comment about McDonald’s indictment.

In a statement about the charges against Brooks, 49ers General Manager Trent Baalke said the team takes any charge against its players seriously and was “in communication with the NFL.” He said Brooks will not participate in Saturday’s preseason game against the Denver Broncos.
